Use rights
The applicable data protection law grants you comprehensive data subject rights (rights of access and intervention) vis-à-vis the controller with regard to the processing of your personal data, which we inform you about below:
- Right to information pursuant to Art. 15 DSGVO: In particular, you have the right to obtain information about your personal data processed by us, the processing purposes, the categories of personal data processed, the recipients or categories of recipients to whom your data have been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it was not collected from you by us, the existence of automated decision-making, including profiling, and, if applicable, meaningful information about the logic involved and the scope and intended effects of such processing concerning you, as well as your right to be informed about which guarantees exist in accordance with Art. 46 of the GDPR if your data is transferred to third countries;
- Right to rectification pursuant to Art. 16 of the GDPR: You have the right to have any inaccurate data relating to you rectified without delay and/or to have any incomplete data stored by us completed;
- Right to deletion pursuant to Art. 17 DSGVO: You have the right to demand the deletion of your personal data if the requirements of Art. 17 (1) DSGVO are met. However, this right does not exist in particular if the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;
- Right to restriction of processing pursuant to Art. 18 DSGVO: You have the right to request the restriction of the processing of your personal data as long as the accuracy of your data, which you dispute, is being verified, if you refuse the erasure of your data due to unlawful data processing and instead request the restriction of the processing of your data, if you require your data for the assertion, exercise or defence of legal claims after we no longer need this data after the purpose has been achieved or if you have lodged an objection for reasons relating to your particular situation, as long as it has not yet been determined whether our legitimate grounds prevail;
- Right to information pursuant to Article 19 of the GDPR: If you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to inform all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right to be informed about these recipients.
- Right to data portability in accordance with Art. 20 DSGVO: You have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request that it be transferred to another controller, insofar as this is technically feasible;
- Right to revoke consent given in accordance with Art. 7 (3) DSGVO: You have the right to revoke consent to the processing of data once given at any time with effect for the future. In the event of revocation, we will immediately delete the data concerned unless further processing can be based on a legal basis for processing without consent. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation;
- Right to lodge a complaint pursuant to Art. 77 GDPR: If you consider that the processing of personal data concerning you infringes the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, workplace or the place of the alleged infringement, without prejudice to any other administrative or judicial remedy.
However, please note that these rights are not unlimited and are subject to our own legitimate interests as well as regulatory requirements.

We use this data to improve the functionality of our website. We may also collect data about your activity on the website (e.g. pages viewed, browsing behaviour, clicks, actions, etc.).
The second category includes personal data, i.e. data that identifies an individual or can identify an individual through reasonable measures. Pursuant to Art. 6 para. 1 lit. b DSGVO, personal data is further collected and processed if you provide it to us for the performance of a contract or when opening a customer account. Which data is collected can be seen from the respective input forms. Deletion of your customer account is possible at any time and can be done by sending a message to the above address of the person responsible. We store and use the data provided by you for the purpose of processing the contract. After complete processing of the contract or deletion of your customer account, your data will be blocked with regard to tax and commercial law retention periods and deleted after expiry of these periods, unless you have expressly consented to a further use of your data or a legally permitted further use of data has been reserved on our part, about which we inform you accordingly below.

- You provide such data to us voluntarily, for example when you register on our website.
- We receive such data when you use our website or access it in connection with one of our services.
- We obtain such data from other providers, services and public registers (for example, data traffic analysis providers).

We use data for the following purposes:
- To communicate with you (send notices regarding our services, provide technical information and handle customer service requests, if applicable).
- To inform you about new updates and services (including direct mail/newsletters).
- For order processing (shipping and payment service providers)
- For statistical and analysis purposes, which serve to improve the website.
Data processing when opening a customer account and for contract processing
Pursuant to Art. 6 para. 1 lit. b DSGVO, personal data will continue to be collected and processed if you provide it to us for the execution of a contract or when opening a customer account.
In addition to the various uses listed above, we may also share personal information with our subsidiaries, affiliates and subcontractors.
In addition to the purposes set out in this Privacy Policy, we may share personal data with our trusted third party providers based in different jurisdictions around the world for the following reasons:
- Hosting and operating our website
- Shipping service provider
- Payment service provider

We pass on your payment data to the commissioned credit institution within the scope of payment processing, insofar as this is necessary for payment processing. Otherwise, we will only pass on the name of the recipient and the delivery address to DHL for the purpose of delivery in accordance with Art. 6 Para. 1 lit. b DSGVO. This information will only be passed on if it is necessary for the delivery of the goods. In this case, prior coordination of the delivery date with DHL or notification of delivery is not possible. For this purpose, your payment data may be passed on to credit agencies in accordance with Art. 6 Para. 1 lit. f DSGVO on the basis of PayPal's legitimate interest in determining your solvency. PayPal uses the result of the credit check in terms of the statistical probability of non-payment for the purpose of deciding on the provision of the respective payment method. The creditworthiness information may contain probability values (so-called score values). Insofar as score values are included in the result of the credit report, they have their basis in a scientifically recognised mathematical-statistical procedure. The calculation of the score values includes, but is not limited to, address data. Google Maps
On our website we use Google Maps (API) from Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Maps is a web service for displaying interactive (land) maps in order to visually present geographical information. By using this service, our location is shown to you and a possible journey is made easier.
When you call up those sub-pages in which the Google Maps map is integrated, information about your use of our website (such as your IP address) is transmitted to Google servers in the USA and stored there. This occurs regardless of whether Google provides a user account via which you are logged in or whether no user account exists. If you are logged in to Google, your data will be directly assigned to your account. If you do not want your data to be associated with your Google profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. Such an evaluation is carried out in particular in accordance with Art. 6 Para. 1 lit.f DSGVO on the basis of Google's legitimate interests in the display of personalised advertising, market research and/or needs-based design of its website. You have the right to object to the creation of these user profiles, whereby you must contact Google to exercise this right.
Google LLC, based in the USA, is certified for the us-European data protection agreement "Privacy Shield", which ensures compliance with the level of data protection applicable in the EU.
If you do not agree to the future transmission of your data to Google in the context of the use of Google Maps, you also have the option of completely deactivating the Google Maps web service by switching off the JavaScript application in your browser. Google Maps and thus also the map display on this website can then not be used.

Information on data processing in connection with Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Ireland Limited. If the data controller on this website is located outside the European Economic Area or Switzerland, Google Analytics data processing is carried out by Google LLC. Google LLC and Google Ireland Limited are hereinafter referred to as "Google".
Google Analytics uses "cookies", which are text files placed on the computer of the website visitor, to help the website analyse how users use the site. The information generated by the cookie about the use of this website by the site visitor (including the shortened IP address) is usually transmitted to a Google server and stored there.
Google Analytics is used exclusively with the extension "_anonymizeIp()" on this website. This extension ensures anonymisation of the IP address by shortening it and excludes any direct personal reference. The extension means that the IP address is shortened beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by the corresponding browser within the scope of Google Analytics will not be merged with other Google data.
On behalf of the site operator, Google will use the resulting information to evaluate the use of the website, to compile reports on website activities and to provide the site operator with further services related to website and internet use (Art. 6 para. 1 lit. f DSGVO). The legitimate interest in the data processing lies in the optimisation of this website, the analysis of the use of the website and the adaptation of the contents. The interests of the users are sufficiently protected by the pseudonymisation.
Google LLC. offers a guarantee based on the standard contractual clauses to maintain an adequate level of data protection. The data sent and linked to cookies, user IDs (e.g. user ID) or advertising IDs are automatically deleted after 50 months. The deletion of data whose retention period has been reached takes place automatically once a month.
The collection by Google Analytics can be prevented by the site visitor adjusting the cookie settings for this website. The collection and storage of the IP address and the data generated by cookies can also be objected to at any time with effect for the future. The corresponding browser plugin can be downloaded and installed under the following link: https://tools.google.com/dlpage/gaoptout.
The site visitor can prevent the collection by Google Analytics on this website by clicking on the following link. An opt-out cookie will be set, which prevents the future collection of data when visiting this website.
Further information on the use of data by Google, settings and opt-out options can be found in Google's privacy policy (https://policies.google.com/privacy) and in the settings for the display of advertising by Google (https://adssettings.google.com/authenticated).
reCAPTCHA
To protect your enquiries via Internet forms, we use the reCAPTCHA service of Google LLC (Google). The query serves to distinguish whether the input is made by a human being or abusively by automated, machine processing. The query includes the sending of the IP address and, if applicable, further data required by Google for the reCAPTCHA service to Google. For this purpose, your input is transmitted to Google and further used there. However, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser as part of reCaptcha will not be merged with other Google data. The deviating data protection regulations of the Google company apply to this data. You can find further information on Google's data protection guidelines at: https://policies.google.com/privacy?hl=de
Corporate transaction
We may share information in the event of a corporate transaction (e.g., sale of substantial parts of a business, merger, consolidation, or asset sale). If any of the above occurs, the acquirer or the relevant company will assume the rights and obligations set out in this Privacy Policy.
Minors
The protection of children's data is very important, especially in the online area. The website is not designed for children and is not aimed at them. The use of our services by minors is only permitted with the prior consent or authorisation of a parent or guardian. We do not knowingly collect personal information from minors. If a parent or guardian becomes aware that his or her child has provided us with personal information without their consent, he or she may contact us at charcoaltrade[at]online.com.
